Naturalization Overview : 

Naturalization is the process by whichUSCIS confers U.S. Citizenship upon a foreign citizen who hasfulfilled certain requirements.

Who May File for Naturalization usingForm N-400

To use Form N-400, the applicant mustbe ONE of the following:

  1. A Lawful Permanent Resident forat least five years and at least 18 years old; 

  2. A Lawful Permanent Resident forat least three years and at least 18 years old,           

                a. AND the applicant has beenmarried to and living with the same U.S. citizen for the last threeyears,

                 b. AND the applicant’s spouse hasbeen a U.S. citizen for the last three years.

      3.  A member of one of several othergroups eligible to apply for naturalization (for example, persons whoare                  nationals but not citizens of the United States) and at least 18years old.

      4. A person who has served honorablyin the U.S. Armed Forces, 

                 a. AND If the applicant is at least18 years old, a Lawful Permanent Resident with at least one year ofU.S.                       Armed Forces service, and the applicant is filing his or herapplication for naturalization while still in the                       service or withinsix months after the termination of such service.

                 b. OR the applicant served honorablyas a member of the Selected Reserve of the Ready Reserve or in                              active-duty status during a designated period of hostilities. Theapplicant then may apply for                                         naturalization without having beenphysically present in the United States for any specified period.

NOTE: If the applicant is married toa U.S. citizen who is employed or deployed abroad, he or she may insome circumstances be eligible for expedited naturalization undersection 319(b) of the Immigration and Nationality Act (INA).
